From the Washington Post:

The vehicle was apparently in motion at the time the tree fell on it....because when the fire department arrived on scene, the transmission was running and the vehicle was still in drive.

Given this info, I don''t think we can blame the deceased for having been "under a tree." As for staying home: look, they were reporters.
