Virge does not depend on whether on the atmosphere is stable or unstable. You can have virga in both situations

A virga event will depend mostly of the following two factors:

1. The distance between the base of the precipitating cloud and the immediate ground surface below. The greater the distance, the higher the chance that you will experience virga.

2. How dry is the air mass below the precipitating cloud. The more dry the layer of air located below the base of the precipitating cloud is, the more likely you will get virga.

So, in this case, it could be either.
