I'm glad you have legal help with all this. I never thought about the same insurance company representing both parties.

I was going to say, I can't even imagine how that works, especially with hiring lawyers, and that hopefully you have legal help outside of any provided by your insurer. But then I don't even know how any of it works. I had to search online to get a little bit of a sense of it and I still don't know. Whoever you go after for medical expenses, make sure it covers everything for now into the future. Truck, previous medical bills and future ones, lost wages and a lot for pain and suffering. I'm sure there are lots of various things that you are talking with your lawyer about. I was also going to say that if you don't have legal counsel outside of ones paid by your insurance company, it would be best to have anything reviewed by another lawyer too before signing anything final. But I don't even know if an auto insurer would provide any lawyers. Maybe some extra coverage would have been needed for that? I'm so clueless on this, I don't know what insurance companies would be involved, regarding auto and medical, and whether you have to sue the other driver personally.

People have insurance of various types to help them personally if ever needed, like auto and medical, but I've never thought much about how someone, or their insurance company, would actually go about collecting money from the person at fault. (so the rates for the innocent person didn't go up in the future)

Obviously insurance companies don't care about anything other than money once they start being on the hook, so they'll be of no help if it is the same insurance company going after itself. But again, I'm so clueless on this. Maybe you have outside lawyers handling all this that will be paid from any settlement.

I think your back, colon and hearing injuries are definitely all related to the accident. A careless driver is responsible for all of it and they should and must be held accountable. (in part so they think twice about doing it again)

I'm so sorry that things continue to be so terrible with this and other personal tragedies. Hopefully after June you will finally be as healthy as you were. It would be nice if the legal process was solved by then, but I assume stuff like that takes time. Hopefully you'll have a truck sooner than that and maybe other things can be fought about between lawyers without you having to deal with it as much. (I don't know if they can make a deal on a single item or not, like the truck) I'm sure it's hard to focus on just the positives, of how lucky you are to still be here from surviving the initial accident and then surviving the life threatening impact of it months later too. Try to focus on that as much as possible until you heal more from your injuries.

I've never had to make much of any auto claim before, and definitely not with the same company as the person who was at fault, so I don't know of any advice on that. I don't even know if you sue the driver personally. My dad and I have kind of switched companies over the years to what is usually cheapest (but a major company), and usually bundled things, so I just don't know a lot about any company. Most recently we were with MetLife and in 2021 or 2022 their home and auto business was bought by Farmers Insurance and that is who we have now for auto. The house is with Citizens because no one wants to touch that one. Hopefully you have some really good lawyers helping you out with all this.

You can create accounts with each of the three credit reporting bureaus to monitor your credit for free. You can monitor it to see how the things Cypress said do impact it. You mentioned your credit taking a hit, so maybe you already have with at least one account, but make sure to monitor all three. You don't usually know which a company will check when checking your credit.
